01 — Professional Cooperation

Swiss Private Properties works with property owners and with established real estate brokers, agencies, developers, advisors and other professional market participants.

We recognise and respect existing professional relationships and representation.

02 — Source Protection

The professional source of a property, client, owner, counterparty or opportunity introduced through Swiss Private Properties or Swiss Private Group is to be respected.

Private introductions made through these relationships are made for the purpose for which they were provided.

A recipient may not intentionally use confidential contact information, owner information or professional introductions obtained through Swiss Private Properties to bypass the originating relationship.

03 — When Protection Applies

General viewing of publicly available catalogue information does not by itself create a protected commercial relationship.

Protection applies where Swiss Private Properties or Swiss Private Group provides or facilitates non-public information or access, including:

• a direct owner or representative introduction;
• confidential property documentation;
• non-public owner or counterparty identity;
• private contact details;
• an off-market opportunity;
• a viewing or meeting arranged through our relationship;
• transaction-specific information;
• or a professional introduction not otherwise publicly available to the recipient.

04 — Confidential Materials

Confidential material supplied through Swiss Private Properties or Swiss Private Group must not be redistributed, republished, reproduced or commercially exploited without authorisation.

Confidential material may include:

• property documentation;
• private photographs;
• owner information;
• client information;
• professional contacts;
• pricing information;
• negotiation information;
• transaction structures;
• off-market opportunities;
• and non-public correspondence.

05 — Non-Circumvention

Recipients of protected introductions or confidential information must not knowingly circumvent Swiss Private Properties, Swiss Private Group or the originating professional partner in relation to the opportunity introduced.

This includes direct or indirect attempts to exploit non-public introductions, owner identities, professional contacts or confidential transaction information obtained through the relationship while excluding the originating parties.

Swiss Private Properties and Swiss Private Group reserve all rights available under applicable law in respect of misuse of confidential information, interference with protected professional relationships or unlawful commercial exploitation.

06 — Professional Partners

Swiss Private Properties aims to maintain transparent and respectful cooperation with professional counterparties.

Where applicable, referral terms, cooperation arrangements, commission-sharing arrangements, client protection periods or other commercial terms may be agreed separately between the relevant professionals.

Nothing in this website replaces a specific written cooperation agreement where one exists.

07 — Client Protection

Client identities, requirements, correspondence, transaction intentions and financial information are treated with discretion.

Client information is communicated to owners or professional partners only where reasonably necessary in connection with the relevant property or requested transaction, subject to applicable law and confidentiality requirements.

08 — Content & Commercial Protection

The Swiss Private Properties catalogue, its original texts, selection, organisation, branding, presentation and proprietary materials are protected by applicable law.

No content from the catalogue may be systematically copied, scraped, reproduced, republished, redistributed or commercially exploited without prior authorisation.

Where a rights holder believes that particular material appearing in the catalogue has been published incorrectly or requires review, the matter may be notified to Swiss Private Properties at [email protected] for review.

09 — Governing Law

This framework is governed by Swiss law.

Swiss Private Properties and Swiss Private Group reserve the right to protect their legitimate interests, confidential information, professional introductions and commercial relationships through all remedies available under applicable law.

Where legally permissible, disputes shall be submitted to the competent courts of the Canton of Vaud, Switzerland, subject to any mandatory jurisdiction applicable to a specific transaction.
